These Terms and Conditions ("Terms") govern your use of this website and any purchase you make from Obscure Radiance ("we", "us", "our"), 15133 Le Grand Road, Le Grand, California 95333. By using the site or placing an order you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the site.
1. Who can buy
You must be at least 18 years old, or the age of majority where you live, to place an order, or use the site with the involvement of a parent or guardian. You agree that the information you give us at checkout is true and complete.
2. Changes to these Terms
We may update these Terms from time to time. The version posted here, with its effective date, applies to orders placed after that date.
3. Products and descriptions
We try to show our products and their colors as accurately as possible. Screens differ, so a color may look slightly different in person. Product photos may include props that are not part of the product.
4. Prices and availability
Prices are in U.S. dollars and may change at any time without notice. Products are subject to availability. If a product or price is listed in error, we may cancel the affected order and refund any payment, even after we have confirmed it.
5. Orders
Your order is an offer to buy. We accept it when we send you a confirmation by email. We may refuse, limit or cancel any order, including orders that appear to be placed by resellers or that we suspect are fraudulent. If we cancel an order after you have paid, we will refund you in full.
6. Payment and taxes
Payments are processed by Square (Block, Inc.). We do not receive or store your full card number. By placing an order you authorize the charge for the total shown at checkout, including any shipping and applicable sales tax.
7. Shipping and delivery
Shipping options and costs are shown at checkout. Unless checkout says otherwise, we ship only to addresses in the United States. Delivery estimates are not guaranteed. Title and risk of loss pass to you when we deliver the package to the carrier. If a package arrives damaged, contact us within 7 days as described in our Return and Refund Policy.
8. Returns, refunds and exchanges
Returns are covered by our Return and Refund Policy, which is part of these Terms.
9. Promotions and discount codes
Discount codes have no cash value, cannot be combined unless stated, are limited to one per order, and may expire or be withdrawn at any time.
10. Shopping assistant
The site includes an automated shopping assistant that can answer questions about our products and policies. Its answers are for information only. The product page and the checkout total are what count for price, availability and order details. Please do not share payment card numbers or other sensitive information in the chat.
11. Intellectual property
The site and its content, including the Obscure Radiance name, the R-and-wheat logo, designs, photos and text, belong to Obscure Radiance or its licensors and are protected by copyright and trademark laws. Luna Llena marks belong to their owners and are used with permission. You may not copy, reproduce or use them for commercial purposes without our written permission.
12. Acceptable use
You agree not to misuse the site, including by interfering with its operation, attempting unauthorized access, scraping it with automated tools, or using it for any unlawful purpose.
13. Third-party services
Checkout, chat and some site features are provided by third parties, such as Square for payments. Their own terms and privacy policies also apply when you use them. We are not responsible for third-party websites linked from our site.
14. Disclaimer
To the fullest extent permitted by law, the site is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. This does not limit any rights you have under our Return and Refund Policy or that cannot be waived under applicable law.
15. Limitation of liability
To the fullest extent permitted by law, Obscure Radiance will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or data, arising from your use of the site or your purchase. Our total liability for any claim related to a purchase will not exceed the amount you paid for the product that gave rise to the claim.
16. Indemnification
You agree to indemnify and hold harmless Obscure Radiance and its owners and team from claims, losses and expenses, including reasonable attorneys' fees, arising from your misuse of the site or your violation of these Terms.
17. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Before filing any claim, please contact us at orfarms.marketing@gmail.com so we can try to resolve it informally within 30 days. Any dispute that is not resolved informally will be handled by the state or federal courts located in Merced County, California, and you consent to their jurisdiction. Either party may bring a qualifying claim in small claims court.
18. General
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the policies they reference, are the entire agreement between you and us about the site and your purchases. We may assign our rights under these Terms; you may not without our consent.
